The short version

Holdable respects intellectual property rights. If you believe a listing on our marketplace infringes your copyright, trademark, or right of publicity, email copyright@holdable.ai with the details below. We aim to remove valid claims within 24 hours.

How to file a copyright (DMCA) notice

To file a takedown notice under the Digital Millennium Copyright Act (17 U.S.C. § 512), send an email to copyright@holdable.ai that includes:

  1. Your name, address, phone, and email.
  2. A description of the copyrighted work you claim has been infringed (link to the original work where possible).
  3. The exact Holdable URL (or URLs) of the allegedly infringing listing(s).
  4. A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  5. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf.
  6. Your physical or electronic signature.

Incomplete notices may not qualify for statutory takedown and may be delayed or denied.

Trademark, right of publicity, and other IP claims

For trademark claims (including unauthorized use of brand names or logos) or right-of-publicity claims (use of a person's name, likeness, or signature without permission), email copyright@holdable.ai with the equivalent information adapted to the claim — what mark or likeness is at issue, where you hold rights (registration number if applicable), the allegedly infringing listing URL, and a signed statement under penalty of perjury that you are the rights holder or authorized agent.

Counter-notice

If you believe your listing was removed in error, you can submit a counter-notice to copyright@holdable.ai. A valid counter-notice must include your contact info, a description of the content removed, the URL where it appeared, a statement under penalty of perjury that the removal was a mistake or misidentification, your consent to jurisdiction in the federal district where you reside (or where Holdable is located if outside the US), and your signature. We may restore the listing 10–14 business days after forwarding your counter-notice to the original claimant, unless they file suit.

Repeat-infringer policy

We terminate accounts of users who repeatedly publish infringing content. Three sustained takedowns against the same account is grounds for permanent removal from the platform, forfeiture of any pending creator payouts, and a ban on creating new accounts. We may act earlier in cases of willful or commercial-scale infringement.

False claims

Knowingly filing a false notice is a federal offense under 17 U.S.C. § 512(f) and may make you liable for damages, including costs and attorneys' fees incurred by Holdable and the affected user. Don't do it.
